1. Introduction and Acceptance

Welcome to Biogarden365!

These Terms and Conditions (“Terms”) govern your access to and use of the Biogarden365 mobile application (“Application”) and the related website (“Website”), collectively the “Service,” operated by Kidologic Kft. (“us,” “we,” or “company”).

By downloading, installing, or using the Application, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree with these terms, please do not use the Service.

2. Description of the Service

Biogarden365 is a gardening assistant designed to help users with organic, bio-intensive, and chemical-free gardening. The main features of the Service include:

• Plant, pest, and disease identification using artificial intelligence.
• An interactive Planting Calendar to help plan garden activities.
• A Moon Calendar for timing biodynamic gardening tasks.
• A visual Garden Planner for designing the layout of beds and plants.
• Daily tips and advice for organic gardening.
• A personal Garden Journal for recording notes and photos.
• An expandable database of plants and pests.

The Service operates on a “freemium” model. Basic features are available for free (e.g., “Green” package) with limited usage, while additional features and unlimited access are available through paid subscriptions (e.g., “Silver,” “Gold” packages). The detailed contents and limits of each package are outlined on the Subscription page within the Application.

3. User Accounts

To access certain features of the Service, you must register for an account. You agree to:

• Provide accurate and current information (especially an email address).
• Maintain the confidentiality of your account password and take responsibility for all activities that occur under your account.
• Use the Service only if you are over 16 years of age.

4. User-Generated Content

You are responsible for all content (text, notes, images, hereinafter “User Content”) that you create or upload through the Service.

• Ownership: You retain ownership of the User Content you upload.
• License to Us: By uploading User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, copy, modify, and display that content solely for the purpose of operating, developing, and provide the Service. This license is necessary, for example, to display your images and notes in your personal garden journal.

5. Subscriptions, Payments, and Cancellation

• Billing: Paid subscriptions are billed on a recurring basis (monthly or annually). The fee will be charged through your chosen payment method (e.g., Apple App Store, Google Play Store).
• Cancellation: You may cancel your subscription at any time through the respective platform’s subscription management settings. The cancellation will take effect at the end of the current paid term. Subscription fees are non-refundable.

6. Prohibited Conduct

While using the Service, you agree not to engage in any of the following activities:

• Engaging in any unlawful activity or uploading unlawful content.
• Harassing other users or misusing their personal data.
• Distributing viruses or other malicious code.
• Reverse-engineering the Service or attempting to access the source code.
• Interfering with the operation of the Service.

7. Intellectual Property

With the exception of User Content, all elements of the Service—including the software, design, logo, text, graphics, and data provided by us—are the exclusive property of Kidologic Kft. and are protected by copyright and other intellectual property laws.

8. Limitation of Liability and Disclaimer of Warranties

The Service is provided on an “as-is” and “as-available” basis, without any express or implied warranties.

We do not guarantee that the identification features are 100% accurate or that the tips provided are applicable in all gardening situations. The information provided by the Service is for informational purposes only and does not constitute professional agronomical advice. Kidologic Kft. shall not be liable for any direct or indirect damages arising from the use of the Service.

9. Termination

• By You: You may terminate this agreement at any time by deleting your account in the Application’s settings.
• By Us: We reserve the right to suspend or terminate your account immediately if you breach these Terms.

10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Hungary, without regard to its conflict of law principles. In the event of any dispute arising from these Terms, the parties agree to the exclusive jurisdiction of the courts of Hungary.
